A meeting of Stoke Gabriel Parish Council was held on

Monday 29th November 2004 at 7.00 pm

 

Ten minutes were allowed at the beginning of the meeting for members of the public to put matters to the Council 

6 members of the public were present 

Present:            Mr R Tully (chairman), Mrs C Hunt, Mr W Deval, Miss P Ellis,

Mr N Hill, Mrs Rowe, Mr B Tarr, Mr C Wigfall

 

1          Apologies –Mr I Jones, Cllr J Hawkins, PC John Hodgson

 

2          Urgent Business brought forward by the Chairman

Monitoring Officer – the Chairman read a letter from Kevin Williams about the investigation into the actions of Mrs Hunt, Parish Councillor and Mrs Rowe, Parish Councillor and District Councillor.  The letter exonerates both councillors from the allegations made against them.  The findings are confidential but a summary will appear on the Standards Board website in due course.

PC John Hodgson’s report was read in his absence:

from a crime point of view the village is very quiet

PC Hodgson will speak with the Highways Officer again regarding removal of yellow lines

bullet

the owners of the Gabriel Court Hotel have complained of incidents of harassment including nuisance phone calls, theft and tampering with equipment.  PC Hodgson is taking these incidents seriously and urges anyone playing practical jokes to think about the consequences of their actions

Hoyle Copse – a letter was received enquiring about rumours of a new village hall being planned on the meadow at Hoyle Copse.  Mr Tarr, in his role as chairman of the Village Hall committee, stated that the site had been suggested as a possible new venue.  However, as there are covenants on the land left to the Parish Council by Miss Birch preventing the erection of buildings, or use by vehicles, Mr Tarr agreed that the suggestion could not be taken any further, and he would report this back to his committee.

 

3          Reports from County and District Councillors

Cllr Hawkins was not present

Mrs Rowe reported the following:

Recycling – householders will eventually be issued with two wheelie bins, and there will be leaflets and roadshows to explain the new system, which will be financed from a Defra grant, not from council tax

bullet

Affordable housing – at least 200 homes will be built next year, mainly at Ivybridge, South Brent and East Allington, with more sites under review at Salcombe, Landscove and Diptford.  This will be partly financed by the council tax on second homes, of which South Hams will receive £2 million

bullet

Public toilets – Mrs Rowe is still campaigning for these to kept open

bullet

Travellers – there are proposed sites at Ipplepen and Denbury

4          Planning

Application

1)  Southlands Farm – erection of polytunnel.  5 letters of objection were received from the public.  Objection

2)  Stoke Gabriel Boating Association – summer pontoon at Mill Point.  Explanations of the plans were given by a representative from the Boating Association and by Capt Tarr.  Objection by majority vote.

3)  Broadleigh Farm – proposed holiday rally 22.7.05-14.8.05.  Mrs Hunt and Mrs Rowe declared a personal interest and left the room. No objection.

4) Kings Cottage – internal refurbishment and renovation works.  Objection to the roof span being above the existing rafter structure. 

 Tree Preservation Orders and Works to Trees

1)  11 Maddicks Orchard – works are exempt

2)  Gabriel Court Hotel – TPO grant of conditional consent to the felling of     several trees.  A map of the site showing the exact trees will be obtained from the Tree Officer

 Applications approved by SHDC

1)  Pine cliff, Byter Mill Lane – amendments to 52/0429/04/F (design alterations)

2)  Paper Shop – display of shop sign, window canopy and display cabinet

Application recommended for refusal by SHDC

1)  Burleigh House, Paignton Road – creation of off-road parking space and alteration to pedestrian access.  Application withdrawn

2)  Burleigh House, Paignton Road – conservation area consent for demolition of boundary wall.  Application withdrawn

  Appeals to Secretary of State

1)  Tullys Mead Farm – storage of 5 caravans.  Appeal dismissed

 

5          Accounts

Payment of the following accounts were proposed by Mrs Hunt and seconded by Mr Wigfall:

6          Matters raised by the clerk

South Hams Citizens Advice Bureau – in reply to their letter asking for donations, the Parish Council agreed to donate £70

Rights of Way – Miss Ellis will study a large document on this subject and reply to the questionnaire

Waste Management – South Hams Council have explained the new recycling system to be phased in during 2005/06 comprising wheelie bins for garden refuse/food waste and household waste, on fortnightly collection.  Paper and cardboard are now being collected together and orange sacks are no longer being issued.  Alternative arrangements will be made for those not able to accommodate wheeled bins.  Mr Tarr expressed concern at the present collection arrangements for bottles from business premises, which end up on landfill sites instead of being recycled.  He will write to South Hams Council on this matter.

Parochial Church Council – they have requested £450 for maintenance of the churchyard.  The Parish Council agreed to pay £400 on this occasion and to point out to the PCC that this does not constitute any form of annual agreement, and that the Council is attempting to keep the precept as low as possible.

Totnes & Dartmouth Ring & Ride – they are requesting donations, but councillors expressed the opinion that if the service does not benefit Stoke Gabriel directly, that funds could be used elsewhere.  The clerk will ascertain whether the service includes Stoke Gabriel, and report back.

Gardening Services – a contractor who is employed privately in the village has expressed a wish to do work for the Parish Council if the need arises.  His details will be kept on file.

Precept 2005/06 – this needs to be set by 14th January 2004 and will be discussed at the next meeting.

SeaBritain 2005 – the Council decided not to commemorate the 200th anniversary of the Battle of Trafalgar.

60th Anniversary of the end of World War II – a letter from the War Widows Association of Great Britain will be published in the parish magazine in case any organisation wishes to hold a local event.

Stoke Gabriel in Bloom – a letter was received from Robin Kimmerling requesting that a representative from the Parish Council attend their meetings.  It was felt that this was not appropriate since the councillor would be one person against many, and that a more suitable approach would be for Stoke Gabriel in Bloom to build time into their schedule to seek approval from the council before digging and planting takes place.

 

7          Minutes of last meeting

The minutes of the meeting of 1st November 2004 were agreed and signed.

 

8          Matters arising from the minutes

Trees at Port Bridge – a letter was received from Dr Rhodes about some land he has acquired at Port Bridge, but it was not clear whether these were the trees in question.  Miss Ellis will discuss this with Dr Rhodes.

Overhanging brambles – the owner of Rosemount has been approached but they have not yet been cleared.

Bus Route 25 – the clerk has received a reply to her letter requesting that the bus stops at New Road.  The company is investigating.

ASBOs – it would appear that the possibility of parish councils/clerks having power to issue Anti-Social Behaviour Orders is being piloted in certain parts of the UK, but does not include this area at present.

Flooding at Whitehill – Mr Tully has spoken to the owner and the matter is in hand. 

9          Highways & Hedgerows

New road surface – the council will write to Devon County highways department congratulating them on the quality of the new road surface into the village and the way in which it was carried out with the mininum of disruption.

Yalberton Road – the “no heavy lorries” sign has not yet appeared.

New benches – Mr Wigfall is awaiting replies from his enquiries.

Hillfield – the “public footpath” sign has been uprooted. 

10        Matters raised by Councillors

Longcombe – following complaints about parked cars outside the car sales business, a letter will be sent asking them to remove the obstructions.

Website – Mr Wigfall reported 5650 visitors, and he also deals with enquiries from past residents.

Hoyle Copse – Mr Deval reported that the working party are planning to produce a booklet of the wood and meadow to be sold in local shops for between £1.50 and £2.  This will explain the history, development work, flora and fauna, maps and aerial photographs.

The second portion of the grant from the Wildlife Trust has been applied for, to provide for fencing, levelling the access lane from Aish Road, and provision of a gate.

The plan to move the access from the Hoyle Lane end has been abandoned due to the high cost involved but the council agreed to pay a portion of the other party’s costs, in consultation with the solicitor.
